(Hereinafter referred to as “the Trainer/Trainer of Sit Walk Stay/Sit Walk Stay”)
The “Owner/Handler/Client/Attendee”, Hereinafter stated in this contract is the person filling out Sit Walk Stay forms, reading and agreeing to this dog training contract. If the Owner decides to bring along family/friends/other people to training session/class/workshop, they also fall under this contract. Sit Walk Stay must be informed of any additional attendees attending.
The Owner wishes to engage the Trainer and the Trainer agrees to undertake the services under the terms and provisions defined in this Dog Training Contract.
Any reference to dog(s) in this contract shall refer to those specified on the Sit Walk Stay Pet Information form(s) and the dog the owner will be who will be attending the training session/class/workshop/other training platform.

1. RELATIONSHIP AND RESPONCIBILITIES
1.1. It is expressly understood that the Owner retains the services of the Trainer as an Independent Contractor and not as an employee.
1.2. The Trainer undertakes to perform the agreed-on services in an attentive, reliable and caring manner and the Owner undertakes to provide all necessary information to assist in this performance.
1.3 The Owner will ensure the dog(s) has been fully vaccinated (including flee & worming) and will maintain all vaccinations as current during the Term of this Contract and understands that if the dog has not met these requirements, your dog(s) cannot attend. Puppies must be fully vaccinated with at least 1 week post their second vaccination to attend classes with other dogs.
1.3b To keep Sit Walk Stay, every attendee and other dogs safe as well as keeping the Owners own dog happy, healthy and compliant for training, the Owner must also notify the Trainer as soon as possible any changes in the dog(s) health, such as; Eye infections, lameness, ear infection, diarrhoea, sick etc.
1.3c The Trainer undertakes to notify the Owner of any occurrence pertaining to the dog which may be relevant to the care and well-being of the dog.
1.4. The Trainer will supply and be equipped with waste bags and will duly remove the dog’s excrement from all public places in a 1-1 (trainer and dog) session. It is the owners responsibility to pick up & bag their own dog(s) poop and dispose properly in other services e.g. class/workshop.
1.4b It is Sit Walk Stay’s responsibility to use cleaning products if in an indoor facility.
1.4c Sit Walk Stay will offer ear protection in a class/workshop environment if dog(s) are barking, if owners do not use ear protection Sit Walk Stay are not liable for any hearing loss/ear related issues.
1.5. The Trainer may use their own training leads and treats agreed with Owner.
1.6. The Owner will provide suitable and correctly fitted harnesses, coats, collars and leads as approved by the Trainer.
1.6b Muzzles; Suitable and fitted Muzzles are required to bring to all training services in case of e.g. injury to the dog which may provoke the dog to act accordingly out of distress, therefore keep everyone and the dog safe owners must bring a well fitted bite proof muzzle. The muzzle must have enough room for the dog to fully pant (to regulate heat and to vomit if needed), the dog must be able to drink with the muzzle on, correctly sized and introduced with positive reinforcement.
1.7. The Owner will ensure the dog is legally licensed with a up to date Microchip and ID Tag. ID tag must be attached to the dog(s) collar and contain Owners name, Full address, postcode and number as per dog law.
1.7b Anyone handling (holding the lead and in control) of the Dog must be at the age of 18 or over. Any persons under the age of 18 who the Owner brings to the session/workshop/class must be under control, this includes; no yelling/crying/screaming as this may disrupt training and stress Dog and other Dogs and attendees in the class/workshop.
1.7c Owners must have their dog and any attendees they bring with them under control at all times.
1.7d 1 (ONE) dog per handler.
1.7d PHOTOS/VIDEOS; Owners/attendees can take photos and/or videos of their own Dog/themselves but cannot take photos or videos of other attendees/Sit Walk Stay staff/pubic/dogs unless granted permission (including any sharing/social media publishing) by that attendee/staff member/public/owners dog.
1.8. Training sessions may consist of One to One with Dog and Trainer, One to One with Trainer, Dog and Owner, as well as Workshops, Group classes (multiple dogs and owners attending) and other Sit Walk Stay training platforms.
1.9. The Trainer shall not be obliged to perform any other duties other than the agreed Training unless agreed upon via additional contractual paperwork.
2. COMPENSATION, SECURITY, BOOKINGS & PAYMENT
2.1 The Trainer warrants to keep safe and confidential all keys, remote control entry devices, access codes and personal information of the Owner and to return same to the Owner at the end of the contract period or immediately upon demand.
2.2. All fees must be paid at the time of booking prior to the service commencing. A booking cannot be made or confirmed without full payment and all form(s) correctly completed. No service nor ‘spot’ will be held until payment and form(s)/contract agreement is confirmed.
2.3. Bookings can only be made via the Sit Walk Stay website (www.sitwalkstay.co.uk), Sit Walk Stays BookWhen or a direct booking link/confirmation & invoice email provided by Sit Walk Stay. Cash payments are not accepted.
2.4. All payments are processed in British Sterling (GBP) at the time of payment. Sit Walk Stay is not responsible for any fees, charges, exchange rates or additional charges levied by the individual financial institutions or credit card companies.
2.5 Though Payment confirmation, booking confirmation, session reminders and/or correspondence from Sit Walk Stay will be sent via email/number the Owner provides, it is the Owners responsibility to ensure they have made note of the session/class and be on location at the correct time(s) and date(s).
2.6. All 1-2-1 training sessions as part of a programme or package must be booked in straight away once payment has been made. This is to ensure continuity in your training and to avoid the disappointment of long breaks between sessions. The frequency of the sessions will be decided between the client and the Trainer at Sit Walk Stay.
2.7. All 1-2-1 bookings of multiple of sessions must be completed within a set time period to ensure continuity and momentum in training and to be completed within 8 weeks.
3. PUBLIC WALKS/CLASSES/WORKSHOPS
3. You must follow the guidelines of the trainer and staff of Sit Walk Stay at all times. Safety briefing will be given at the start of training walk/class/workshop.
3.1. Please be friendly with members of public, other attendees in the class/workshop and traffic on the roads. You may be required to wear a high visibility vest or similar, which will be provided.
3.1b Dogs in class/workshop must be apart from one another (a minimum of 2 metres) unless instructed otherwise by Sit Walk Stay.
3.1c Owners/attendees cannot approach another dog unless agreed by the Owner of the dog and agreed. Owners/attendees cannot give treats to other dog unless agreed by the dogs Owner.
3.2. It is the clients responsibility to make sure that dogs are made comfortable whilst left in their vehicle. This includes sufficient airflow/circulation through the car and access to water.
3.3. The participation of any service offered by Sit Walk Stay is at your own risk, which means the responsibility lies with the client themselves. We therefore make you aware that you should hold insurance (both owner and owners dog) to be able to participate in any service.
3.4. Sit Walk Stay takes all reasonable precautions within the structure of our services to avoid injury resulting from dog bites. However, Sit Walk Stay accepts no responsibility for damage or injury resulting from dog bites occurring to clients or their dogs while attending services, this will be between the two clients/client and other dogs owner.
3.5. The client is fully responsible for any damages/harm done by either themselves, their dogs or any other clients/owners/handlers that came with them. For example trailing/scent work class you may trail through brambles, sharp edges etc which may cause cut/bruising etc.
3.5b. As per above, it is recommended to the Owner to bring protective clothing to protect Owner/dog/handlers to avoid damage/harm. This may include; suitable foot ware for environment, long strong trousers, long strong tops, gloves, coat and spare clothing.
3.6 Classes/Workshops will still go ahead in good old English weather (rain, wind, cold) so it is recommended to be prepared and bring clothing for all weathers. All clients booked onto sessions must be aware of these possibilities. If a session is abandoned, alternatives will be offered. No refunds shall be given.
3.6b. Classes/Workshops may be held outdoors and is subject to varying complications that may require us to abandon a session due to safety, including but not limited to: extreme heat, thunderstorms, high winds or too few clients booked on. A minimum of three clients are required to safely run a class/workshop if dogs are left in vehicles.
4. DURATION
4.1. This Dog Training Contract shall come into effect on the date stated when booking the training session/class/workshop/other training.
4.2. Any client/owner/attendees participating in introduction courses, classes, workshops, training or any other services that are offered by Sit Walk Stay agrees not to conduct/hold/offer such or similar, to the general public or another business or third parties within the United Kingdom. ONLY with written consent from Sit Walk Stay can this agreement be changed. If for any reason Sit Walk Stay terminates the contract due to below (Early termination - owner violence etc), does not release the owner or attendees to this agreement.
5. CANCELLATION - EARLY TERMINATION - REFUNDS OF 1-1’s/CLASSES/WORKSHOPS
5.1. Cancellation by the Owner of scheduled 1-1 sessions with less than 72 (seventy-two) hours' notice may not be refunded or may be rescheduled at the discretion of the Trainer at Sit Walk Stay.
5.2. Should the dog(s) or owner/attendee(s) become aggressive or dangerous, or for any reason, the Trainer of Sit Walk Stay may terminate this Dog Training Contract with immediate effect.
5.3. Should the Owner(s) become disrespectful or violent, the Trainer may terminate this Dog Training Contract with immediate effect.
5.4. Any wrongful or misleading information in the Owner’s Information or Pet Information sheets may constitute a “breach of terms” of this Dog Training Contract and be grounds for instant termination thereafter.
5.5. Termination under the circumstances described in all of the above shall not entitle the Owner to any refunds nor relief of any outstanding payments due.
5.6. Subject to any statutory rights of cancellation, payments for 1-2-1 training, classes, workshops, events, membership fees or gift certificates are non-refundable and non-transferable unless otherwise stated in these Terms and Conditions or stated upon booking. Refunds, if any, shall be made entirely at Sit Walk Stay’s discretion.
5.7. If the client moves outside Sit Walk Stay’s service area before, or once 1-2-1 training has commenced, a refund will not be given. The option to complete the sessions via zoom or for the client to come to a location within a 20 minute radius of SP101JD will be offered.
5.8. If the client fails to attend a 1-2-1 session or class no refund shall be given.
5.9 If the client is more than 15 minutes late for a 1-2-1 training session and has not corresponded with SWS to inform them of the delay, the session will be cancelled and no refund shall be given and no time will be added to the session if client is late (for example if client is 10 minutes late to a 1 hour session, there will be only 50 minutes left of the session).
6. No refunds will be given if a client decides not to use the full number of sessions from a purchased programme, class or workshop. No refunds will be given for missed classes, nor can clients attend classes beyond the designated timetable they booked on to.
6.1. CLASSES/WORKSHOPS withdraws - No refunds will be given if a client withdraws from a class before their start date. If the space on the course can be filled, then credit of the course price (minus 10% admin fee) will be given to the client to use for an additional purchase from SWS services.
6.2. If any dog under the contract does not respond well to the training plan and/or other dogs. This includes, but not limited to, dogs that are not comfortable in a class environment. Alternative services may apply.
6.3. Any wrongful or misleading information in the Owner’s Information or Pet Information sheets may constitute a “breach of terms” of this contract and be grounds for instant termination thereafter. If the Owner is non compliant or withholding information with regards to the behaviour of their dog(s), including but not limited to aggression, which could compromise the safety of SWS staff, volunteers or other attendees, then the contract will be terminated immediately and no refund given.
6.4. Refunds, if any, shall be made entirely at Sit Walk Stay’s discretion. Any refunds granted at the discretion of SWS will be paid to the Owner on the card the original service was booked with. Please note, 10% will be deducted to cover admin cost. Refunds can take up to seven working days to appear in the Owners account.
6.5 All of the above shall not entitle the Owner to any refunds nor relief of any outstanding payments due.
7. RESCHEDULING OF 1-2-1's
7.1. Sit Walk Stay is a small self employed business and cannot function with prolonged rescheduling of sessions from clients. However, Sit Walk Stay appreciates that life events and circumstances outside of the clients control can happen and aims to be flexible within reason, within the limits of our business hours and the terms and conditions stated in this contract.
7.2. Sit Walk Stay permits the following number of rescheduled sessions per booking. Upon reaching the limits stated below, the client will lose any further sessions they require to be rescheduled and no refund shall be given.
- Single 1 hr session can be rescheduled only once (with 72 hours or more notice)
- Package or Programme block of sessions permits (5 sessions or more) a maximum of 2
rescheduled sessions (with 72 hours or more notice)
7.3 Any further requests for sessions to be rescheduled beyond the limits stated above will only be granted at the discretion of Sit Walk Stay.

8. LIABILITY
8.1. The Trainer of Sit Walk Stay accepts no liability for any breach of security or loss of or damage to the Owner’s property if any other person has access to the property during the term of this agreement.
8.2. The Trainer shall not be liable for any mishap of whatsoever nature which may befall a dog(s) or caused by a dog(s) who has unsupervised access to the outdoors.
8.3. The Owner shall be liable for all medical expenses and damages resulting from an injury to Sit Walk Stay/Trainer, staff, volunteers and other participants/attendees in the class/workshop, caused by the Owner’s dog or the Owner. The Owner shall also be liable to damage to the Owner’s property, Sit Walk Stay/Trainer’s property or other attending (to the class/workshop) Owners property.
8.4. The Trainer is released from all liability related to transporting dog(s) to and from any veterinary clinic or kennel, the medical treatment of the dog(s) and the expense thereof.
8.5. Trainer accepts no responsibility if “the dog(s)” in question does no retain trained behaviours due to lack of the Owners commitment to advised upon actions including but not limited to the following “homework, additional advice or requested behaviour & training techniques/guidance/advice”.
8.6. Trainer accepts no responsibility for repeated behaviours returning due to un-due stress/Instinct/discomfort outside of the control of the Trainer.
9. INDEMNIFICATION
9.1 The Owner cannot force the Trainer to pay any and all costs, expenses, losses, liabilities and claims arising from said dog(s) behaviour on a training session/class/workshop/walk/transport of said dog(s) unless the trainer/staff at Sit Walk Stay is wilful negligent and proven to be/admitted by court of law.
10. EMERGANCIES
In the event of an emergency in a 1-1 session with trainer and dog, the Trainer shall contact the Owner at the number(s) provided to confirm the Owner’s choice of action. If the Owner cannot be reached within 3 attempts, the Trainer is authorized to:
10.1. Transport the dog(s) to the listed veterinarian;
10.2. Request on-site treatment from a veterinarian;
10.3. Transport the dog(s) to an emergency clinic if the previous two options are not feasible.
10.4. In training whether 1-1, classes or workshop, by agreeing to this contract, Sit Walk Stay is allowed to undertake Canine First Aid in the event of an emergency and is not liable for any fee(s) for damages caused by life-saving measures.
11 PHOTOS – VIDEOS – SOCIAL MEDIA
11.1 Owners/attendees can take photos and/or videos of their own Dog/themselves but cannot take photos or videos of other attendees/Sit Walk Stay staff/pubic/dogs unless granted permission (including any sharing/social media publishing) by that attendee/staff member/public/owners dog.
11.2 Sit Walk Stay will inform Owners/Attendees of any photos/videos going on before session/class /workshop begins – it is therefore any attendees responsibility who do not wish to be videoed/photo’d to be out of shot (you may be in the background but not sole focus of shot, we will do our best to blur out faces/edit out who do not wish to be photographed but cannot always promise)
11.3 The Owner allows Sit Walk Stay take photos and videos of Owners and their Dog(s) to show progression/explanation/for Owners & Trainers notes. The Owner agrees and gives permission by agreeing to this contract that Sit Walk Stay can publish photos and/or videos (taken of the Owner, their dog(s) and any attendees the Owner brings) to Sit Walk Stay’s public platform (Facebook, Instagram, TikTok, Website and can share post to groups on the internet for Sit Walk Stay advertisement) unless agreed and informed otherwise by the Owner to Sit Walk Stay.
