Walking Contract

India Seddon Tegan Goulty (Hereinafter referred to as “the Walker/Walker of Sit Walk Stay”) Address - 113 Corunna Main, Andover, SP101JD Phone Number – 079393 58587 Email – sitwalkstay@outlook.com The Owner wishes to engage the Walker and the Walker agrees to undertake the services under the terms and provisions defined in this Sit Walk Stay Dog Walking Contract. Any reference to dogs or pets in this contract shall refer to those specified on the Pet Information sheet(s).

 

1. Relationship and Responsibilities

1.1. It is expressly understood that the Owner retains the services of the Walker as an Independent Contractor of Sit Walk Stay and not as an employee.

1.2. The Walker of Sit Walk Stay undertakes to perform the agreed-on services in an attentive, reliable and caring manner and the Owner undertakes to provide all necessary information to assist in this performance.

1.3 The Owner will ensure the dog(s) has been fully vaccinated (including flee) and will maintain all vaccinations as current during the Term of this Contract and understands that if the dog has not met these requirements, the dog is vulnerable. The Owner must also notify The Walker as soon as possible any changes in the dog(s) health, such as; Eye infections, lameness, ear infection etc.

1.4. The Walker of Sit Walk Stay undertakes to notify the Owner of any occurrence pertaining to the dog which may be relevant to the care and well-being of the dog.

1.5. The Walker of Sit Walk Stay will supply and be equipped with waste bags and will duly remove the dog’s excrement from all public places and may use their own leads and treats unless stated otherwise on the Pet Information Sheet.

1.6. The Walker of Sit Walk Stay reserves the right to walk other compatible dogs at the same time but undertakes to limit the number of dogs walked with one person to 6 (Six)

1.7. The Owner will provide suitable harnesses, collars and leads as approved by the Walker as well as coats or muzzles if required.

1.7a Extendable/Long line leads will only be used if and when Safe to do so.

1.7b Dog(s) who have Off Leash signed by the Owner must have reliable recall in all areas and distractions.

1.8. The Owner will ensure the dog is legally licensed (including up to date ID Tag) in the municipality in which the Owner resides and will maintain the license (including subsequent renewals) during the Term of this Contract.

1.9. The Walker of Sit Walk Stay shall not be obliged to perform any other duties other than dog walking unless agreed upon via additional contractual paperwork.

2. Compensation

2.1. The Walker of Sit Walk Stay shall be paid the amount stated in the confirmation email and invoice(s) sent by the Walker of Sit Walk Stay (sitwalkstay@outlook.com)

3. Duration

3.1. This Dog Walking Contract shall come into effect on the date stated above.

3.2. Should the Owner wish to terminate this Dog Walking Contract, the Owner must give the Walker a minimum of 3 weeks written notice of termination.

4. Cancellation or Early Termination

4.1. Cancellation by the Owner of scheduled walk(s) with less than 72 (Seventy-two) hours notice will not be refunded or may be rescheduled at the discretion of the Walker of Sit Walk Stay.

4.2. Where the Walker of Sit Walk Stay as sole proprietor needs to cancel a scheduled walk due to unforeseen circumstances within 24 hours of the scheduled walk, the Walker may appoint a substitute Walker with the approval of the Owner and any difference in the fees shall be charged at the expense of the Walker unless discussed and approved by the Owner.

4.3. Should any dog become aggressive or dangerous, the Walker may terminate this Dog Walking contract with immediate effect.

4.4. Should the Owner(s) become disrespectful, violent or for any reason, the Walker may terminate this Dog Walking contract with immediate effect.

4.5. Any wrongful or misleading information in the Owner’s Information or Pet Information sheets may constitute a “breach of terms” of this Dog Walking Contract and be grounds for instant termination thereafter. 4.7. Termination under the circumstances described in 4.3, 4.4 or 4.5 above shall not entitle the Owner to any refunds nor relief of any outstanding payments due.

 

5. In Season Dog(s)

5.1. Should the Owners dog(s) come into season, the Owner must notify the Walker as soon as possible. Scheduled walk(s) will be replaced with House Visit(s) unless agreed otherwise.

5.2. In season dog(s) will not join group walks nor solo walked for a duration of approximately 4 weeks. From first signs of coming into season (swelling, change in behaviour etc.- Bleeding). Once bleeding has stopped, a minimum of 2/3 weeks before commencing walks and bath to clear any season scent.

 

6. Liability

6.1. The Walker of Sit Walk Stay accepts no liability for any breach of security or loss of or damage to the Owner’s property if any other person has access to the property during the term of this agreement.

6.2. The Walker of Sit Walk Stay shall not be liable for any mishap of whatsoever nature which may befall a dog(s) or caused by a dog(s) who has unsupervised access to the outdoors.

6.3. The Owner shall be liable for all medical expenses and damages resulting from an injury to the Walker caused by the dog as well as damage to the Owner’s property and Walker's property.

6.4. The Walker of Sit Walk Stay is released from all liability related to transporting dog(s) to and from any veterinary clinic or kennel, the medical treatment of the dog(s) and the expense thereof.

 

7. Indemnification The Owner cannot force the Walker to pay any and all costs, expenses, losses, liabilities and claims arising from said dog(s) behaviour on a walk/transport of said dog(s) unless the dog walker is wilful negligent and proven to be/admitted by court of law.

 

8. Emergencies In the event of an emergency, the Walker shall contact the Owner at the numbers provided to confirm the Owner’s choice of action. If the Owner cannot be reached within 3 attempts, the Walker is authorized to (Unless the dog(s) is in life-or-death situation, the walker will transport dog straight to veterinarian, thereafter contact the owner

8.1. Transport the dog(s) to the listed veterinarian; Request on-site treatment from a veterinarian; Transport the dog(s) to an emergency clinic if the previous two options are not feasible.

8.2. By agreeing to this contract, the Walker of Sit Walk Stay is allowed to undertake Canine First Aid in the event of an emergency and is not liable for any fee(s) for damages caused by life-saving measures.

 

9. Security The Walker of Sit Walk Stay is to keep safe and the confidentiality of all keys, remote control entry devices, access codes and personal information of the Owner and to return same to the Owner at the end of the contract period or immediately upon demand. Keys will require a signed form on receipt and return.

 

10. Payment All services rendered by the Walker of Sit Walk Stay for the Owner will require payment upfront (on a monthly basis unless services rendered as a single walk only). An invoice will be issued once a month (unless services rendered as a single walk only). Payment will be required before or on the indicated date on the invoice also all payment will be required to state the correct (PO) reference as indicated on the invoice given (failure to do so could lead to late charges). Any late payments will incur a £5 fee each day the payment is overdue until payment received. Any non-payment will be met with court action and all incurred fees from said action will be liable and payable by the Owner.

11. Use of information and contract

11.1 Sit Walk Stay does not give permission for reuse for any purpose of any information or contracts given or taken from Sit Walk Stay. Re-use of any information or contracts presented under the Sit Walk Stay name will be liable under court of law as a breach of copyright or contract. 

12. Non-Compete

12.1 The Owner confirms that by agreeing to this contract that they enter into a non compete with Sit Walk Stay. All information, training processes and documents related to Sit Walk Stay continue  to be property of Sit Walk Stay and no permission is given to re-use or replicate. The Owner participating in introduction courses, seminars, workshops, instructor courses, training or any other services that are offered by Sit Walk Stay agrees not to conduct/hold/offer such or similar, to the general public or another business or third parties within the United Kingdom. ONLY
with written consent from Sit Walk Stay can this agreement be changed. Once use of Sit Walk Stay services have concluded The Owner cannot without written permission Hold/Conduct/Offer such or similar, to the general public or another business or third parties within the United Kingdom for a period of 12 months. Any breach of the non-compete will result in law recourse.
